Dilma gastou de mais, não cumpriu a meta fiscal e agora quer mudar a legislação O que é Lei de Responsabilidade Fiscal (LRF): É a lei que define como o governo federal, estados e municípios podem aplicar o dinheiro público. A LRF estabelece os limites para essas despesas e tem como um dos objetivos evitar que os governantes gastem mais recursos do que dispõem, mantendo, assim, as contas públicas em dia. A Lei de Diretrizes Orçamentárias (LDO) orienta a preparação dos Orçamentos Públicos, definindo quais as despesas serão ou não obrigatórias e, entre outros pontos, qual deverá ser a poupança a ser feita pelo país. A LRF define em seu artigo 4º que um dos objetivos da LDO é o “equilíbrio entre receitas e despesas”. O parágrafo 1º desse mesmo artigo diz: “Integrará o projeto de Lei de Diretrizes Orçamentárias o anexo de metas fiscais, em que serão estabelecidas metas anuais, em valores correntes e constantes, relativas a receitas, despesas, resultados nominal e primário e montante da dívida pública, para o exercício a que se referirem e para os dois seguintes” . Na hipótese de descumprimento da meta de superávit primário, nome técnico para a poupança no setor público, a irresponsabilidade fiscal é definida como crime de responsabilidade (Lei número 1.079/1950). O estouro das contas. A LDO fixou a meta de superávit primário para 2014 em R$ 116,1 bilhões. O governo já havia aprovado no Congresso autorização para descontar dessa até R$ 67 bilhões. Gastos que já somam R$ 130,4 bilhões. Quer dizer: em vez de descontar da meta de superávit os R$ 67 bilhões já previstos na LDO, o desconto passaria para R$ 130,4 bilhões. Como essa cifra é superior do que a própria meta de R$ 116,1 bilhões, a manobra de mudança na LDO tem um único objetivo: salvar a presidente Dilma do crime de responsabilidade previsto na Constituição e na Lei 1.079. Crime de Responsabilidade. O artigo 85 da Constituição define que são crimes de responsabilidade os atos do Presidente da República que atentem contra a Constituição Federal e, especialmente, contra: I – a existência da União; II – o livre exercício do Poder Legislativo, do Poder Judiciário, do Ministério Público e dos Poderes constitucionais das unidades da Federação; III – o exercício dos direitos políticos, individuais e sociais; IV – a segurança interna do País; V – a probidade na administração; VI – a lei orçamentária; VII – o cumprimento das leis e das decisões judiciais. A Lei 1.079, o capítulo VI, trata dos crimes contra a lei orçamentária. Diz o artigo 10º, no seu item 4, que é crime de responsabilidade: “infringir, patentemente, e de qualquer modo, dispositivo da lei orçamentária.” O eventual crime de responsabilidade da presidente da República pode ser configurado também pelo descumprimento do artigo 4º. da Lei 12.952 de 2014 (Lei Orçamentária Anual LOA), que determinou que a abertura de créditos suplementares ( ou adicionais) estava condicionada ao alcance da meta de resultado primário (poupança) estabelecida. A meta foi descumprida e, mesmo assim, por meio de 53 decretos, a presidente Dilma gastou em créditos suplementares mais de R$ 180 bilhões. ESSA APROVAÇÃO COMEÇA A SE MATERIALIZAR ATRAVÉS DE PROJETO DE LEI. ESTE É APROVADO OU NÃO NAS DUAS CASAS LEGISLATIVAS. OCORRE QUE QUANDO O GOVERNO FEDERAL MANTÉM MAIORIA DOS CONGRESSISTAS SOB SEU DOMÍNIO, POR MEIO DE PROCEDIMENTOS E FAVORES MUITAS VEZES OBSCUROS, A TENDÊNCIA É QUE OS PROJETOS FAVORÁVEIS AO EXECUTIVO SÃO APROVADOS SEM NENHUMA OU QUASE NENHUMA RESISTÊNCIA. ULTRAPASSADOS OS LIMITES DETERMINADOS PELA LEI DE RESPONSABILIDADE FISCAL, FICA O CHEFE DO EXECUTIVO, PRESIDENTE, GOVERNADOR OU PREFEITO, SUJEITO À RESPONSABILIDADE POR EXCESSO DE GASTO E PROVACAR DÉFICIT NAS CONTAS PÚBLICAS. ISSO JÁ É MOTIVO SUFICIENTE PARA INSTAURAÇÃO, POR MEIO DE COMISSÃO PARLAMENTAR DE INQUÉRITO (CPI), DE PROCEDIMENTO ADMINISTRATIVO NO CONGRESSO, NA ASSEMBLÉIA OU CÂMARA DOS VEREADORES. ESSE PROCEDIMENTO ADMINISTRATIVO PODE, CONFORME PROVAS MATERIAIS QUE FOREM PRODUZIDAS, RESULTAR EM CRIME DE RESPONSABILIDADE, QUE LEVADO AO SUPREMO TRIBUNAL FEDERAL PODE LEVAR À UM IMPEACHMENT. POR ISSO O FATO DE NÃO APROVAÇÃO DO PLN 36 É DETERMINANTE PARA QUE HAJA POSSIBILIDADE DE INSTAURAÇÃO DE CRIME DE RESPONSABILIDADE, PREVISTO CONSTITUCIONALMENTE. Entenda por que não aprovar o PLN 36 é o caminho para o impeachment de Dilma. Esta imagem é emblemática. O líder do DEM, deputado Mendonça Filho (PE) enfrenta sozinho o trio de pelegos do PMDB, formado por Eduardo Braga, que está vendendo o corpo e a alma por um ministério, por Romero Jucá, o eterno líder do governo e por Renan Calheiros, um dos maiores envolvidos no Petrolão e em todos os escândalos da República nos últimos 20 anos. O governo petista, apoiado pelo PMDB e outros partidos da base alugada, tenta aprovar no Congresso Nacional o Projeto de Lei de número 36/2014, que é uma afronta à Constituição Federal, uma manobra ilegal e imoral que consiste em retirar dos gastos totais do governo o dinheiro utilizado no PAC e dessa forma evitar que a presidente desobedeça a LDO e não tenha a obrigação de gerar superávit primário. Na quarta-feira passada, a Oposição conseguiu evitar que o projeto fosse aprovado. Ele voltará à pauta na próxima terça-feira, às 12 horas, em reunião do Congresso Nacional. A Oposição é minoria e somente com pressão popular os deputados e senadores poderão ser constrangidos a votarem contra ou a não comparecerem na sessão, não dando quórum para a votação. Abaixo, entenda, segundo o PSDB, as razões pelas quais é importante derrubar este projeto golpista de Dilma Rousseff. Dilma gastou de mais, não cumpriu a meta fiscal e agora quer mudar a legislação O que é Lei de Responsabilidade Fiscal (LRF): É a lei que define como o governo federal, estados e municípios podem aplicar o dinheiro público. A LRF estabelece os limites para essas despesas e tem como um dos objetivos evitar que os governantes gastem mais recursos do que dispõem, mantendo, assim, as contas públicas em dia. A Lei de Diretrizes Orçamentárias (LDO) orienta a preparação dos Orçamentos Públicos, definindo quais as despesas serão ou não obrigatórias e, entre outros pontos, qual deverá ser a poupança a ser feita pelo país. A LRF define em seu artigo 4º que um dos objetivos da LDO é o “equilíbrio entre receitas e despesas”. O parágrafo 1º desse mesmo artigo diz: “Integrará o projeto de Lei de Diretrizes Orçamentárias o anexo de metas fiscais, em que serão estabelecidas metas anuais, em valores correntes e constantes, relativas a receitas, despesas, resultados nominal e primário e montante da dívida pública, para o exercício a que se referirem e para os dois seguintes” . Na hipótese de descumprimento da meta de superávit primário, nome técnico para a poupança no setor público, a irresponsabilidade fiscal é definida como crime de responsabilidade (Lei número 1.079/1950). O estouro das contas. A LDO fixou a meta de superávit primário para 2014 em R$ 116,1 bilhões. O governo já havia aprovado no Congresso autorização para descontar dessa até R$ 67 bilhões. Ocorreu, no entanto, o pior cenário: o governo perdeu o controle sobre os gastos e o Tesouro Nacional acumulou até o mês de setembro um déficit de mais de R$ 15,7 bilhões! Frente ao desastre, o Palácio do Planalto pede agora ao Congresso autorização para descontar da meta, sem limites, todos os investimentos que fez em obras do PAC e 100% da perda de receita que teve com as desonerações tributárias. Gastos que já somam R$ 130,4 bilhões. Quer dizer: em vez de descontar da meta de superávit os R$ 67 bilhões já previstos na LDO, o desconto passaria para R$ 130,4 bilhões. Como essa cifra é superior do que a própria meta de R$ 116,1 bilhões, a manobra de mudança na LDO tem um único objetivo: salvar a presidente Dilma do crime de responsabilidade previsto na Constituição e na Lei 1.079. Crime de Responsabilidade. O artigo 85 da Constituição define que são crimes de responsabilidade os atos do Presidente da República que atentem contra a Constituição Federal e, especialmente, contra: I – a existência da União; II – o livre exercício do Poder Legislativo, do Poder Judiciário, do Ministério Público e dos Poderes constitucionais das unidades da Federação; III – o exercício dos direitos políticos, individuais e sociais; IV – a segurança interna do País; V – a probidade na administração; VI – a lei orçamentária; VII – o cumprimento das leis e das decisões judiciais. A Lei 1.079, o capítulo VI, trata dos crimes contra a lei orçamentária. Diz o artigo 10º, no seu item 4, que é crime de responsabilidade: “infringir, patentemente, e de qualquer modo, dispositivo da lei orçamentária.” O eventual crime de responsabilidade da presidente da República pode ser configurado também pelo descumprimento do artigo 4º. da Lei 12.952 de 2014 (Lei Orçamentária Anual LOA), que determinou que a abertura de créditos suplementares ( ou adicionais) estava condicionada ao alcance da meta de resultado primário (poupança) estabelecida. A meta foi descumprida e, mesmo assim, por meio de 53 decretos, a presidente Dilma gastou em créditos suplementares mais de R$ 180 bilhões. Diz o artigo da LOA/2014: “ Fica autorizada a abertura de créditos suplementares, restritos aos valores constantes desta Lei, excluídas as alterações decorrentes de créditos adicionais, desde que as alterações promovidas na programação orçamentária sejam compatíveis com a obtenção da meta de resultado THE END |
