Arguments Against

Voting has progressed in technology from traditional days when voters dropped votes marked on a shell, shard of pottery, or card into a box to the current days where voting is controlled by electronics and the processes leading to the vote remain unseen to the human eye. Despite the change in method of voting, the basic facets of good voting tactics remain the same: ensuring one vote per voter, maintaining voter anonymity, accuracy of vote, security of the system, and prevention of fraud.

This is where the problem lies in many arguments against electronic voting opponents do not feel that the voting basics can be maintained in an electronic voting system. The arguments have been divided into 3 general categories of complaints: issues with the technology, vast possibilities of fraud, and protection of voters and their votes.

As Bruce Schneier describes it, technology adds more steps to the process and thus increases the possibility of error with each additional step, all of which are largely unseen by the voter. Put Murphys Law of whatever can go wrong, will go wrong into play, and one can surmise that technology will most likely falter. Not only does the technology create more errors in the electronic workings, but the voters can also commit mistakes due to confusion with the user interface. The terminology is confusing, different machines produce different interfaces, and even the audio guides to help the disabled may prove more confusing than helpful.

With the advent of electronic machine voting also comes the higher possibilities of fraudulent machines and practices. First of all, the technology is black box software, meaning that the public is not allowed access into the software that controls the voting machines. Although companies protect their software to protect against fraud (and to beat back competition), this also leaves the public with no idea of how the voting software works. It would be simple for the company to manipulate the software to produce fraudulent results. Also, the vendors who market the machines are in competition with each other, and there is no guarantee that they are producing the machines in the best interest of the voters and the accuracy of the ballots.

Lastly, vote accuracy is also an issue, because voters have no way of confirming there vote, and there is also no way of conducting a recount with direct-recording electronic (DRE) voting. With DRE, there is no paper trail, no verification, and thus no scrutiny of the processes. Voter anonymity is also a problem. Voters have to provide much of their personal information to the systems for voter verification, and with that comes the problem of keeping voter information safe and keeping voters anonymous.

The cons against electronic voting laid out here are only some of the arguments against electronic voting. However, they are a good reflection of the ethical and technical concerns related to the issue of electronic voting.

The  Brazilian Social Democrat Party (PSDB) agreed on Tuesday, 6, to the Superior Electoral
Court (TSE) the last details for the release of data from polls of the last
presidential election. The data will be available to the party in the next
hours and the work team is already  organized
 to audit the electronic  is expected
to start working next week. Two months after the TSE dismiss the claim made by
the party. The information was confirmed by the party lawyer and coordinator of
the work, Flávio Henrique Costa. It is expected that a final report is released
in 60 days.
Until the
agreement tailored this week, people connected to the team that will make the
audit showed annoyed at the delay in the release of data by the TSE. According
to the lawyer of the PSDB, technical details prevented the transfer was done
before.

The party
agreed with two demands made by the President of the Supreme Electoral Court,
Minister Dias Toffoli: to maintain the confidentiality of data until the
process is complete and submit a work plan that includes a final report
substantiated. "Our work is based on the TSE data, to check the operation
of the system data, the aggregation process of the vote and the results
transmitted by the various organs of Elections," Mr. Costa said.

The Legal Coordinator
of Mr. Neves campaign and author of the audit request, Mr Carlos Sampaio
(PSDB-SP) says that the review of data will bring security to the electoral
process. According to Sampaio, there is suspicion about the election and the
audit can only solve them.

The responsible
team for auditing is almost agreed, but the coordinator of the work avoids
mention all members because contracts are not signed and staff will also have
to commit to the requirements of the Electoral Court. However, the “Opice Blum”
office, which is already working with the PSDB, will be part of the group.

In a court hearing in beginning of  November, the TSE rejected the request of the
PSDB that an official audit to be done on the data, but authorized the release
of documents that the party did its own review.

O PSDB acertou nessa
terça-feira, 6, com o Tribunal Superior Eleitoral os últimos detalhes para a
liberação dos dados das urnas da última eleição presidencial. Os dados estarão
à disposição do partido nas próximas horas e a equipe de trabalho já montada para
fazer a auditoria da votação eletrônica deve começar a trabalhar na próxima
semana, mais de dois meses depois de o TSE julgar o pedido feito pelo partido.
As informações foram confirmadas pelo advogado da legenda e coordenador dos
trabalhos, Flávio Henrique Costa. A expectativa é de que um relatório final
seja divulgado em 60 dias.
Até o acordo costurado nesta semana, pessoas ligadas à equipe que
vai fazer a auditoria se mostravam incomodadas com a demora na liberação dos
dados pelo TSE. Segundo o advogado do PSDB, detalhes técnicos impediram que o
repasse fosse feito antes.
O partido concordou com duas exigências feitas pelo presidente do
Tribunal Superior Eleitoral, Dias Toffoli: manter confidencialidade dos dados
até a conclusão do processo e apresentar um plano de trabalho que inclui um
relatório final fundamentado. "Nosso trabalho é, a partir dos dados do
TSE, fazer verificação da operacionalização dos dados do sistema, do processo
de totalização dos votos e das transmissões dos resultados pelos diversos
órgãos da Justiça Eleitoral", disse Costa.

Coordenador jurídico da campanha de Aécio e autor do pedido de
auditoria, o deputado Carlos Sampaio (PSDB-SP) diz que a revisão dos dados
trará segurança para o processo eleitoral. Segundo Sampaio, há desconfiança
sobre o pleito e só a auditoria poderá saná-las.
A equipe responsável pela auditoria está praticamente fechada, mas
o coordenador dos trabalhos evita citar todos os integrantes porque os
contratos ainda não estão assinados e os funcionários também terão de se
comprometer com as exigências da Justiça Eleitoral. Mas já certo é que o
escritório Opice Blum, que trabalha com o PSDB, fará parte do grupo.
Em audiência no início de novembro, o TSE rejeitou o pedido do
PSDB de que fosse feita uma auditoria oficial nos dados, mas autorizou a
liberação de documentos para que o partido fizesse sua própria revisão.
